2. Product Availability and Pricing Accuracy
All products listed on our website are subject to availability. While we strive for accurate and timely updates, Island Toys & Hobbies reserves the right to limit quantities of certain items. Should there be an error in pricing, we reserve the absolute right to cancel any affected orders and will make reasonable efforts to notify the customer promptly to resolve the matter with either a full refund or a revised order at the correct price, subject to customer consent.
3. Returns and Warranties
Our Return & Warranty Policy, available here, defines our conditions and practices regarding returns and warranty claims. All standard-priced items may be returned within thirty (30) days from the date of purchase, provided the item remains unused, in its original packaging, and in like-new condition. Sale or discounted items are final sale and are not eligible for return or refund.
Island Toys & Hobbies upholds the manufacturers’ warranty policies for the products we sell, and these policies may vary based on the manufacturer. Warranty claims must be initiated within the manufacturer’s specified warranty period and require proof of purchase and clear documentation (including photos) of the defect.
4. Chargebacks, Disputes, and Customer Communication
Chargeback Resolution Policy: Customers agree to first attempt to resolve any issues directly with Island Toys & Hobbies prior to initiating a chargeback or dispute with their payment provider. Should a chargeback be filed without prior communication with us, Island Toys & Hobbies reserves the right to submit evidence to demonstrate compliance with these Terms & Conditions and any specific return and warranty policies applicable to the case.
5. Customer Responsibilities and Acknowledgements
Customers bear the responsibility of inspecting and reviewing items upon receipt and notifying Island Toys & Hobbies of any issues, defects, or warranty claims within the prescribed warranty period. Island Toys & Hobbies disclaims any responsibility or liability for product issues not reported within this designated period. It is expressly understood that Island Toys & Hobbies is not liable for damages or losses arising from product use that falls outside of manufacturer recommendations, nor for issues we have not been duly informed of as per these policies.
Assumption of Risk: By purchasing and using any product sold by Island Toys & Hobbies, the customer assumes any and all risks associated with the use, functionality, or maintenance of the product, subject to applicable laws.
6. Limitation of Liability
Island Toys & Hobbies disclaims all express or implied warranties, including, but not limited to, any implied warranties of merchantability and fitness for a particular purpose, except as specifically set forth in the manufacturer’s warranty, if applicable. To the maximum extent permitted by British Columbia law, Island Toys & Hobbies shall not be liable for any direct, indirect, incidental, consequential, or special damages resulting from the use of any product, even if Island Toys & Hobbies has been advised of the possibility of such damages.
7. Governing Law and Jurisdiction
These Terms & Conditions, as well as any disputes arising from or relating to them, shall be governed by and construed in accordance with the laws of the Canada. Any legal action or proceeding concerning these terms shall be brought in the appropriate courts of British Columbia, and customers hereby consent to the exclusive jurisdiction of such courts.
